Melrose Rocks Official Rules:
- NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
- tokidoki Melrose Rocks (the 'Promotion') is open only to legal residents of the fifty (50) United States (including District of Columbia) and Canada who are at least eighteen (18) years old at the time of entry (the 'Entrants'). Employees of Tokidoki, LLC and their affiliated companies and agencies as well as the immediate family and household members of each such employee are not eligible. Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited. Participation constitutes Entrant's full and unconditional agreement to these Official Rules. Winning the Prize is contingent upon fulfilling all requirements set forth herein.
- The Promotion begins on October 1, 2009 at 12:00 a.m. PST and ends on October 23, 2009 at 11:59 p.m. PST. The Administrator's computer is the official time keeping device for this Promotion.
- During the Promotion Period, go to http://www.tokidoki.it/melroserocks and complete and submit the online entry form, including a valid home address. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Only one entry per person. Any attempt by any Entrant to obtain more than one entry by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Entrant's entries and that Entrant may be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant. No responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. The Winner will be selected on or around the week of 10/25/2009 and will be notified by registered mail, email or telephone. If the Winner cannot be located or fails to claim the Prize within ten (10) days after notification, the Prize will be forfeited and awarded to an alternate winner. The Winner will be randomly selected from all eligible entries via an automated computer system.
- tokidoki will not be responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Promotion or receipt or use or misuse of any prize. If for any reason an Entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant's sole remedy is another entry in the Promotion.
- The Prize consists of one (1) $1,000 tokidoki shopping spree, two (2) VIP tickets to the tokidoki Melrose Store Opening and a trip for two (2) to Los Angeles. Trip package includes roundtrip, coach-class air transportation for two (2) from a major airport near winner's home (determined by tokidoki in its sole discretion) to Los Angeles; three (3) days and two (2) nights accommodations at a hotel determined by tokidoki in its sole discretion (single room, double occupancy). Trip is subject to availability and blackout dates. Travel must be roundtrip. tokidoki will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Promotion, and those set forth by tokidoki's airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes, tips or other expenses are the responsibility solely of Winner. Travel restrictions, conditions and limitations may apply. If in the judgment of tokidoki air travel is not required due to Winner's proximity to the Prize location, ground transportation will be substituted for roundtrip air travel at tokidoki's sole discretion. tokidoki will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Odds of winning the Prize depend on the number of eligible entries received during the Promotion Period.
- The Winner must be available for roundtrip travel to Los Angeles during and around the week of December 7, 2009. The Winner must also be available to attend the tokidoki Melrose Store Opening on or around December 10, 2009. If the Winner is unavailable, the Prize will be forfeited and awarded to an alternate winner.
- The Prize is non-transferable and non-refundable. The Prize may not be substituted or redeemed for cash by Winner. However, tokidoki reserves the right to substitute the Prize with a prize of equal or greater value in the event the original prize offered is not available due to circumstances beyond tokidoki's reasonable control.
- tokidoki accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Promotion or accepting the Prize. tokidoki further disclaims liability for any injury or damage to your or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Promotion. By participating, the Winner releases, discharges, indemnifies, and holds harmless tokidoki and affiliated companies, and their respective officers, directors, employees, agents, and representatives, from any and all liability, loss, harm, injury, damage, cost and expense whatsoever arising directly or indirectly from the use of the Prize or participation in the Promotion.
- By entering the Promotion, the Winner consents, without limitation or additional compensation, to the use of their name, voice, photograph, likeness and/or entry for advertising and/or trade purposes, except where prohibited by law.
- All federal, state and local taxes are the sole responsibility of the individual Winner. The Winner may be required to sign an IRS form 1099 or the equivalent for all prizes valued at $600 or greater or for any prize as to which tokidoki, in its sole discretion, believes is warranted. tokidoki may require verification of eligibility and identity of the Winner before releasing the Prize.
- Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Central District of California or the California State Court located in Los Angeles, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and tokidoki in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
